How does POPIA impact AI adoption in South Africa?

- Applies to all processing of personal information within South Africa or where South African law applies
- Eight conditions for lawful processing: accountability, processing limitation, purpose specification, further processing limitation, information quality, openness, security safeguards, and data subject participation
- Requires prior authorisation for processing special personal information, children's data, and automated decision-making
AI Governance
Section 71 requires that data subjects are not subject to decisions based solely on automated processing, including profiling, that produce legal effects or significantly affect them, unless specific conditions are met.
Cross-Border Transfers
Personal information may only be transferred outside South Africa if the recipient country provides an adequate level of protection, or the data subject consents, or the transfer is necessary for contract performance.
